WebDiet® Privacy Policy

WebDiet, Inc. (the "Company") provides an interactive multi-media application in connection with www.webdiet.com and other related sites (collectively, the "Website") that assists users looking to lose weight, monitor their nutritional intake, and receive dynamic meal suggestions based on their location and other personal needs, requirements and preferences (collectively with the Website, the "Service").

This Privacy Policy sets forth the online data collection and usage policies and practices that apply to you, and your use of the Service. By using or accessing the Service, you accept the practices described in this Privacy Policy.

1. What information do we collect and how is it used?

You may visit and use many features of the Service without any registration, in which case none of your personal information will be collected or retained. Some of the features of the Service require you to create a user profile and become a "Registered User" by providing us with some basic information about you. You can choose to receive the free email newsletter without becoming a Registered User simply by providing your name and email address here.

There are two types of information that we collect from you when you use the Service. First is information that is unique to you and that identifies you as an individual, or "Personal Information". Personal Information includes, but is not limited to, your name, email address, telephone number, credit card information, and mailing address. Except as provided in this Privacy Policy, we do not share your Personal Information to any third party. This means that we won't sell your email address or other Personal Information to anyone.

The other type of information that we collect is "Non-Personal Information" which does not identify you or any person as an individual. Non-Personal Information includes, but is not limited to, data such as your internet service provider, your web browser type, or even aggregated user statistics such as how many users over the age of 30 utilize the Service. Aggregate data is collected to build higher quality, more useful services by performing statistical analyses of the collective characteristics and behavior of our Users. We may provide statistical information based on this data to advertisers and other current and potential business partners. Cookies, which are small electronic files placed on your computer by our webpage server, are also a type of Non-Personal Information, and are used to store your user preferences and to record information about your visit to our Website. You can prevent cookies from being placed on your computer by configuring your web browser, but you will need to enable cookies on your browser to use many of the functions of the Service.

Our advertising partners may set cookies that allow their ad server to recognize your computer each time an advertiser sends you an online advertisement. In this way, ad servers may compile information about where you, or others who are operating your computer, saw their advertisements and determine which ads are clicked through by you. This information allows an ad network to deliver targeted advertisements that they believe will be of most interest to you. We do not control these third party cookies and advertisers' use of cookies is subject to their own privacy policies, not this Privacy Policy.

2. When would we share your Personal Information?

We will never sell your Personal Information, and will generally never share your Personal Information with any third party. The times that we may share your Personal Information will be when we believe disclosure is necessary to: (i) conform to legal requirements or to respond to a subpoena, search warrant or other legal process received by Company, whether or not a response is required by applicable law; (ii) enforce the WebDiet Terms of Use ; (iii) to protect our rights; or (iv) protect the safety of members of the public.

3. How do we protect visitor information?

We use industry-standard technologies to protect your information that is stored within our database, and we restrict access to your information to those employees who need access to perform their job functions, such as our customer service personnel and technical staff. Your Registered User account is secured by a password created by you. Please note that we cannot guarantee the security of Registered User account information. Unauthorized entry or use, hardware or software failure, and other factors may compromise the security of the Service.

4. How does a visitor remove or modify their Personal Information?

You can remove your Registered User information from our database by cancelling your Registered User account. If you chose to receive the free email newsletter without becoming a Registered User, you can unsubscribe by clicking on the unsubscribe link at the bottom of the email message or by using the contact form on the Website CONTACT page. Please note: if you post any information to the public areas of the Website such as forums and message boards, then that information will remain visible to visitors to the Website.

5. Third party links and co-brand relationships

In an attempt to provide increased value to our visitors, we may choose various third party websites to link to and from, and frame within, our own Website. Company may also participate in co-branding and other relationships to offer information, programs and other services and features to you and other users of the Service. However, even if the third party is affiliated with the Website or Service, we have no control over these linked sites, and each of these sites have separate privacy and data collection practices independent of ours. Mobile device carriers may be able to track personal information about you too. As such, we have no responsibility or liability for these independent policies or actions, and are not responsible for the privacy practices or the content of any such websites or providers. Any linked sites are only for your convenience and you access them at your own risk. Accordingly, please carefully review the data collection policies on each of these websites and providers.

6. Our note to parents

Children under the age of 18 are not permitted to use the Service without the permission of a legal guardian. We therefore do not knowingly collect any information from users of the Service who are under 18 unless we have permission to do so by their parent or legal guardian.

7. Your consent, policy changes and change of ownership

By using the Service, you consent to the collection and use of information by us as set forth in this Privacy Policy. If we decide to change our Privacy Policy, we will post those changes on this page so that you will always be aware of what information we collect, how we use it, and under what limited circumstances we disclose it. Continued access or use of the Service shall constitute your express acceptance of any modifications to this Privacy Policy. In the event that Company or a substantial portion of Company's assets are acquired, Personal Information collected and retained in accordance with this Privacy Policy may be transferred to the acquiring party.
